Terms of Service
These Terms of Service ("Terms") govern access to and use of the Yamador customer engagement platform, the Yamador Messaging Hub, and related services (together, the "Services") provided by شركة البرمجيات الحديثة لتقنية المعلومات ("Barmajeyyat", "we", "us"). The Services are business software offered to organisations ("Customer", "you"). By using the Services, you agree to these Terms. Where a signed agreement exists between Barmajeyyat and the Customer, that agreement prevails over these Terms in case of conflict.
1. The Services
Yamador enables organisations to design, approve, execute, and measure customer outreach campaigns across messaging and voice channels, including SMS, email, voice, and — through Meta Platforms' APIs — the WhatsApp Business Platform, Messenger, and Instagram messaging. The Yamador Messaging Hub relays messages and events between a Customer's Yamador deployment and connected messaging platforms.
2. Accounts and access
- Customers are responsible for the actions of users they authorise and for keeping credentials confidential.
- Access is role-based; Customers configure their own users, roles, and approval workflows.
- You must provide accurate business information and keep it current.
3. Customer responsibilities and acceptable use
You are responsible for your campaigns, audiences, and message content. You agree to:
- Obtain and maintain valid consent (opt-in) from message recipients where required by applicable law and by the policies of each channel;
- Honour opt-outs promptly and maintain accurate do-not-contact records;
- Comply with all applicable laws and regulations, including telecommunications, consumer-protection, and data-protection laws;
- Comply with the terms and policies of the channels you use, including the Meta Platform Terms, the WhatsApp Business Messaging Policy and Commerce Policy, and the policies applicable to Messenger and Instagram messaging;
- Not use the Services to send spam, deceptive, fraudulent, threatening, or unlawful content, or content that infringes the rights of others;
- Not attempt to circumvent the Services' security, rate limits, or compliance controls.
We may suspend or restrict use of the Services where we reasonably believe these Terms or a channel's policies are being violated, or where required by a platform provider or by law.
4. Third-party platforms
Messaging channels are operated by third parties. Customers own their accounts on those platforms — including their WhatsApp Business Account and their direct billing relationship with Meta — and bear the fees those platforms charge. Barmajeyyat acts as a technology provider and is not responsible for third-party platform availability, policy decisions, pricing, or account actions taken by platform operators.
5. Data protection
Our processing of personal data is described in our Privacy Policy. For end-user data processed on the Customer's behalf, the Customer is the data controller and instructs the processing. Each party will comply with the data-protection laws applicable to it.
6. Intellectual property
The Services, including Yamador software, documentation, and branding, are and remain the property of Barmajeyyat and its licensors. Customers receive a limited, non-exclusive, non-transferable right to use the Services for their internal business purposes. Customer data remains the property of the Customer.
7. Availability and support
Service levels, support terms, and maintenance windows are defined in the applicable customer agreement. We may update the Services from time to time, provided updates do not materially reduce core functionality.
8. Disclaimers and limitation of liability
Except as expressly stated in a signed customer agreement, the Services are provided "as is" without warranties of any kind, whether express or implied. To the maximum extent permitted by law, Barmajeyyat is not liable for indirect, incidental, special, or consequential damages, loss of profits, or loss of data, and our aggregate liability arising out of or relating to the Services is limited to the amounts paid by the Customer for the Services in the twelve months preceding the claim.
9. Termination
Either party may terminate as set out in the applicable customer agreement. Upon termination, the Customer's access ends and transiently buffered data in the Yamador Messaging Hub is deleted in accordance with our retention schedule.
10. Governing law
These Terms are governed by the laws of the jurisdiction in which شركة البرمجيات الحديثة لتقنية المعلومات is registered, unless otherwise agreed in a signed customer agreement. Disputes are subject to the competent courts of that jurisdiction.
11. Changes to these Terms
We may revise these Terms from time to time. The effective date above reflects the latest revision; continued use of the Services after changes take effect constitutes acceptance.
